"Embellishing Maqāsid and Their Impact on Family Fiqh Rulings According to the Hanbali School: From the Book 'Al-Rawd Al-Murabba' by Al-Bahuti"

Abstract

This research aims to study the embellishing Maqāsid , which are a fundamental part of the categories of the Sharia Maqāsid , positioned below the levels of necessities and needs, focusing on promoting the best manners and noble ethics. Generally, Sharia Maqāsid , including the embellishing ones, have not received sufficient applied studies to clarify their concept, divisions, and applications across various jurisprudential domains. Hence, the idea of this research emerged to shed light on the embellishing Maqāsid  theoretically, by exploring their concept and relationship with other Maqāsid , and practically, by examining the effects and applications of these Maqāsid  in family Fiqh, which serves as a fertile field for embellishing Maqāsid  within the context of Hanbali jurisprudence. The research concludes by categorizing the embellishing Maqāsid  within the jurisprudential sections related to family Fiqh into several types, each elucidated with practical examples, thus making these Maqāsid  more accessible and paving the way for further systematic applied studies. The study recommends initiating a scientific project titled "Derivation of Branches Based on Sharia Maqāsid ," as there is a need to establish a new discipline that links jurisprudential branches with Sharia Maqāsid , similar to how scholars in the past developed the discipline of deriving branches from legal principles to study fundamental rules from an applied perspective
